How a court case about pot could doom the printed gun

A Texas law student has created a huge stir by printing out a functional handgun using a 3-D printer. But will a court decision about marijuana influence the matter?

The eight-month experiment by Cody Wilson ended with a gun that can be assembled out of plastic parts, and made potentially lethal with the addition of a household nail and a bullet. Video has surfaced of Wilson firing the gun during testing.

Wilson put the plans on the Internet for free, and they were quickly downloaded by more than 100,000 people.

The project was also quickly condemned by politicians. Chuck Schumer, the U.S. senator and gun control advocate from New York, wants plastic guns banned by Congress.

Schumer?s concerns include the theory that the gun could be smuggled past airport security and used on an airplane, and that widespread access to the gun?s blueprints could lead to an explosion of cheap guns.

Schumer pointed to a character played by John Malkovich in the movie In the Line of Fire who builds a plastic and wooden gun in an attempt to assassinate a president.

The debate over plastic guns goes back several decades, including a reference in Die Hard 2 to the alleged ability of the Glock 17, an Austrian-made pistol, to get through scanners because of its ceramic body.

Critics of the 3-D plastic gun were quick to point out several factors. First, a gun made from plastic would have a short shelf life, and it could pose a greater danger to its user than an intended victim because of the construction material.

One deterrent would be the cost of buying a 3-D printer (starting at a $1,000) and the materials needed. (Wilson?s used printer cost $8,000.) Guns are available online, in stores and on the street at much lower prices.

Schumer also expressed a concern about how regulating the publishing of gun-making instructions could have First Amendment considerations.

?Obviously there are First Amendment issues,? Schumer told CNBC, as reported on the Free Republic website. ?We?ve had this issue about bombs being put on the Internet in the past. And obviously someone could go overseas and put something on the Internet where our laws don?t govern.?

The issue of homemade guns has been taken up by the courts in the past. In the case of United States v. Stewart in 2003, the U.S. Ninth Circuit Court of Appeals overturned a part of judgment against Robert W. Stewart, Jr., who sold parts kits online to make homemade machine guns. (Stewart was also charged with gun possession from a prior case.)

The Supreme Court decided not to hear the Stewart case, but it told the Ninth Circuit to reconsider it in light of another Supreme Court case, Gonzales v. Raich.

In the Raich case, the court ruled that the Commerce Clause gave Congress to right to ban homegrown marijuana, even when states approved it for medical uses, because of the potential effects on interstate commerce.

In 2006, the Ninth Circuit issued a new ruling in the Stewart case, saying that, ?We therefore hold that Congress had a rational basis for concluding that in the aggregate, possession of homemade machine guns could substantially affect interstate commerce in machine guns.?

Wilson?s group is set up as a 501(c)3 non-profit. He doesn?t sell the pistol?s plans, but he does sell plastic gun parts unrelated to the pistol as part of his fundraising efforts. He also accepts online donations and has ads from online parts sellers.

For now, the debate over Wilson?s gun will probably center on its legality under current regulations. The plans require a six ounce piece of metal as part of the pistol, to meet requirements under the Undetectable Firearms Act.

Last fall, Wilson had issues with the maker of the 3-D printer. In October 2012, Stratasys seized a printer that Wilson had leased from the company. He later bought the second-hand printer to complete his project.

At the time, Wilson told reporters he thought his project was legal and he talked to the Bureau of Alcohol, Tobacco, Firearms and Explosives, which told him the idea of a plastic gun was in a regulatory ?grey area.?

The AP reported that Wilson had obtained a manufacture?s license from the ATF before making his pistol.

Jason Salzman: GOP Attacks Democrat on Immigration, Despite Having Coffman as Their Candidate

The National Journal reported last week that the National Republican Congressional Committee has released an ad attacking Democrat Andrew Romanoff for favoring "the strictest immigration laws in the nation" which Romanoff "passed as Speaker of the Colorado House." Romanoff is challenging Rep. Mike Coffman, who's seen as in danger of losing the 6th Congressional District seat in Colorado.

The 2006 anti-immigration law cleared the Colorado Legislature with bi-partisan support, including the backing of Romanoff and Gov. Bill Owens.

But if Republicans attack Romanoff on immigration, reporters should obviously spotlight Coffman's own record on the issue. The Journal's Ben Terris did a pretty minimalist job of this, pointing out the following about Coffman:

When he first ran in 2008, one of his planks was to "deny amnesty and a path to citizenship to those who violate our laws. But this year, he had a change of heart and all of a sudden supports a path to citizenship.

Terris should have written more about Coffman and immigration.

To begin with, Terris misleads us when he writes that Coffman supports a citizenship path. Coffman does not favor a path to citizenship for our country's 11 million undocumented immigrants, except for a subset of immigrant children who were brought here illegally by their parents. (Other reporters made the same mistake and corrected it.)

The truth is Coffman voted against the Dream Act, and based on his current position, he'd vote against it again. Coffman advocates a path to citizenship for young undocumented immigrants who enlist in the U.S. military, but not for those who graduate from high school or college. The Dream Act offers a military and education path to citizenship.

Coffman, you recall, introduced a bill mandating English-only ballots, even for areas with large numbers of Spanish-speaking voters who aren't proficient in English.

Coffman has long stood with (and endorsed) Rep. Tom Tancredo, who symbolizes American extremism toward undocumented immigrants and immigration reform.

Coffman actually accused Obama in 2011 of rushing "illegal immigrants" onto the voting rolls to help Obama win the 2012 election, and Coffman has yet to provide evidence for this.

Coffman's opposition to Obamacare, to common-sense tax policy (He opposed Ref. C.), and his hostility toward government assistance to the poor, like the expansion of Medicaid, are out of step with most Hispanic voters and are linked to the politics of the immigration debate.

To this day, the "On the Issues" section of Coffman's website has this to say, and this only, about "immigration:" "Comprehensive immigration reform must first begin with the comprehensive enforcement of our immigration laws. We must secure the borders of the United States now."

The list goes on, and reporters covering Coffman's strange maneuverings on immigration should become familiar with it.

Benghazi whistleblower: Has diplomat Gregory Hicks suffered for speaking out?

Gregory Hicks told a House panel that superiors opposed his meeting with House investigators and his questioning of claims that the Benghazi attacks were 'spontaneous.' He was reassigned to a desk job.

Has US diplomat Gregory Hicks suffered political retaliation for revealing details of the lethal terrorist attack in Benghazi, Libya, last Sept. 11? That?s a big question raised by Wednesday?s House Committee on Oversight and Government Reform.

Mr. Hicks was the deputy chief of mission in the US Embassy in Libya at the time. Yesterday, he gave a gripping account of the day?s events, from the moment he was alerted that the Benghazi consulate was in danger (he was in Tripoli, watching TV at the time) to the ?saddest phone call I?ve ever had in my life," which informed him that US Ambassador Chris Stevens had died.

But the part of his testimony that has Washington buzzing Thursday deals with allegations that he?s been punished for speaking out, both publicly and within the State Department bureaucracy.

Hicks described at length a phone call from Cheryl Mills, chief of staff to Secretary of State Hillary Clinton. Ms. Mills was ?upset? that he?d met with House investigators looking into Benghazi after being told he should not, he said. She questioned why a State Department lawyer wasn?t in that meeting. Hicks said the lawyer didn?t have the proper security clearance.

Hicks also asked other superiors why Susan Rice, US ambassador to the UN, had said the attack might have been a spontaneous reaction to an anti-Islamic video. That video was a ?non-event? in Libya, Hicks said, adding that it seemed clear from the first that the assault was a terrorist attack.

?The sense I got was I needed to stop the line of questioning,? Hicks told the House panel.

Since then, he?s been demoted, Hicks said. He?d been told he could expect a ?good level of assignment? in the wake of his performance in the Libya tragedy. Instead, he?s been returned to Foggy Bottom and given a desk job as a foreign affairs officer.

? 'Foreign affairs officer? is a designation that is given to our civil service colleagues who ? frankly who are desk officers.... So I?ve been effectively demoted from deputy chief of mission to desk officer,? said Hicks.
