ABA's Legal Ed Section Approves Questionnaire Changes on Reporting ...

It's official: The ABA's Section of Legal Education and Admissions to the Bar has approved changes to its annual law school questionnaire to include more employment and placement information about graduates.

The changes, recommended last month by the council's questionnaire committee, were announced in a press release by the section Wednesday.

The section said in a statement (PDF) that it believes the new information will bring additional transparency to the data reporting system it uses and provide useful information to assist prospective students and graduates in making career decisions.

Under the changes, law schools will be required to report how many graduates are employed in jobs requiring a law degree; how many are in jobs in which a law degree is preferred; how many are in another professional or nonprofessional job; and how many are in jobs whose type is unknown.

Law schools also must disclose how many graduates are working in full-time or part-time jobs, whether those jobs are short-term or long-term and how many of them are funded by the school from which the job-holder graduated.

Schools must report how many graduates are unemployed or pursuing a graduate degree, and how many of the unemployed are looking or not looking for a job. They also must identify the top three states in which their graduates are employed, the number of graduates working in each state and the number of graduates working overseas. These and other proposed changes were recommended in June.

Collection of the new data will begin next spring for the graduating class of 2011 and will be displayed on the section's web site by late spring or early summer. The information will be published in the ABA-LSAC Official Guide to ABA-Approved Law Schools and on the Law School Admission Council's website.

Iran may release detained U.S. hikers soon: lawyer (Reuters)

TEHRAN (Reuters) ? Iran may release U.S. citizens detained on charges of espionage, their lawyer Masoud Shafiee told Reuters on Saturday, a day before a scheduled court session for the two coinciding with the second anniversary of their detention.

Josh Fattal, Shane Bauer and Sarah Shourd were arrested by Iranian forces in July 2009 on suspicion of spying after crossing into Iran from Iraq. Shourd was freed on bail in September 2010 and returned to the United States.

Under Iran's Islamic law, espionage can be punished by execution.

"Tomorrow it will be two years since my clients were jailed ... I believe their already two years in detention will serve as their sentence," Shafiee said. "I hope it will be their last court session."

In November, Iran's judiciary announced espionage charges against the three. Their families said they were hiking and had strayed across the border accidentally. Washington says the charges are totally unfounded and they should be released.

The last hearing was scheduled for May 11 but was postponed without any explanation. Iranian authorities had previously called on Shourd to return to Tehran to stand trial alongside Fattal and Bauer.

Asked whether Shourd would appear at the session, Shafiee said the court had not demanded that she should attend. "It is one of the signs. In the previous warrants Shourd was asked to return to Iran for the trials ... but this time there is no such demand," he said.

Bauer and Fattal pleaded not guilty at a closed-door court hearing on February 6 but the lawyer said he had had no recent legal access to his clients.

"So far, no permission has been granted to my request for a private meeting with my clients," Shafiee said.

"Despite asking repeatedly, I have not met them since the last trial," he said. "I hope to have a meeting with them even a few hours before tomorrow's trial."

The United States cut diplomatic ties with Tehran after the Iranian revolution in 1979. The two countries are now embroiled in a row over Iran's nuclear program, which the West suspects is aimed at making bombs. Tehran denies this.

Some Iranian officials and newspapers had suggested that the

Americans may be swapped with jailed Iranians in the United States. But U.S. Secretary of State Hillary Clinton said there were no talks between the United States and Iran on a prisoner exchange.

Iran said in 2009 it believed 11 Iranians were being held in the United States.

CBS Films hires former Sony executive (Reuters)

LOS ANGELES (TheWrap.com) ? Longtime Sony Pictures executive Scott Shooman has been hired by CBS Films as executive vice president of acquisitions, the studio announced on Thursday.

Shooman will report to CBS Films chief operating officer Wolfgang Hammer and be responsible for the studio's acquisition operations.

Shooman joins the studio following a decade at Sony Pictures, where he rose to the level of vice president of acquisitions and productions.

Low taxes, high health costs make US choices tough (AP)

WASHINGTON ? Wealthy countries all over the world are dealing with debts and strained budgets as they mop up after the Great Recession and brace for the budget-busting retirement of the baby boomer generation.

But the United States is in a bigger fix than almost anyone else.

The U.S. federal debt was equal to 95 percent of the overall economy in the first three months of 2011, the fifth-highest on the Associated Press Global Economy Tracker, an analysis of economic and financial data from 30 of the biggest economies.

Every year that the U.S. government spends more than it collects in taxes, it records an annual budget deficit. The $14.3 trillion debt is the sum of all annual deficits and surpluses.

As U.S. policymakers argue over raising the federal borrowing limit and slashing debts, America is hobbled in ways the others are not. Tax collections are low by historical and international standards. Health care costs are astronomical ? and still rising. The political system is gridlocked.

Those problems suggest the current impasse over raising the U.S. government's borrowing limit and cutting the deficit is a prelude to even more intense political combat.

"We as a society will either have to pay more for our government, accept less in government services and benefits, or both," says Douglas Elmendorf, director of the nonpartisan Congressional Budget Office. "For many people, none of those choices is appealing ? but they cannot be avoided for very long."

This year's federal tax revenues are forecast to equal 14.4 percent of gross domestic product, a broad measure of economic output, according to the Office of Management and Budget.

That's the lowest share since 1950, long before Congress approved expensive programs such as Medicare. Tax collections have been reduced by the recession and by tax cuts enacted in 2001 and 2003. Among 29 countries ranked by the Organization for Economic Development and Cooperation, only Japan and Spain take in less tax revenue than the U.S. as a percentage of GDP.

When it comes to health care, the U.S. spends the equivalent of 17.4 percent of its GDP ? by far the highest percentage among wealthy nations. The next highest is the Netherlands, where health care spending equals 12 percent of GDP. Among the 34 wealthy countries that belong to the OECD, health care spending averages less than 9.5 percent of GDP.

Political gridlock magnifies America's debt woes. Among the five biggest countries with a top AAA rating from the credit rating agency Moody's, the U.S. is the only one that hasn't come up with a serious plan to control government debt, says Moody's sovereign debt analyst, Steven Hess.

The U.S. is also the only one of the five that doesn't have a parliamentary system, which allows the ruling party or coalition to pass its agenda undeterred by the opposition. After taking control last year in Britain, for instance, a coalition led by the Conservative Party enacted an austerity program of tax hikes and spending cuts.

The U.S. has a divided government ? Democrats control the White House and Republicans control half of Congress. The effort to narrow annual budget deficits and reduce the debt has bogged down in partisan wrangling.

The AP Global Economy Tracker found most of the wealthy nations of the world struggling with high debt:

? Japan, which is aging rapidly and has endured more than a decade of economic stagnation, had the heaviest debt burden at the end of the first quarter: 244 percent of GDP. Economists Kenneth Rogoff of Harvard University and Carmen Reinhart of the Peterson Institute for International Finance say anything above 90 percent starts to weigh down economic growth partly by pushing up interest rates. Greece's debt was at 161 percent, Italy's 113 percent, Thailand's 111 percent and the United States' 95 percent.

? Energy-producing Canada and Norway had some of the lowest debt burdens among wealthy nations at 32 and 31 percent, respectively. The Norwegian government's finances are so strong that it issues debt mainly to ensure it has a functioning debt market and turns a profit by investing the money it borrows, says Nikola Swann, an analyst at credit rating agency Standard & Poor's.

? Fast-growing developing countries have a big advantage over rich countries when it comes to containing debts. They have younger populations and aren't facing a baby boomer retirement crunch. Brazil (28 percent) and Mexico (27 percent) had light debt burdens relative to GDP.

The U.S. does have a couple of advantages over other rich countries that help it hang onto its top credit rating even as its debts rise and political squabbling over the federal borrowing limit raises the risk of default.

Thanks to a relatively high birth rate and an even higher rate of immigration, the U.S. is aging more slowly than other rich countries. It will have a higher percentage of people working over the next few decades than Europe and Japan. Those workers will pay taxes to finance health care and pension benefits for baby boomers.

The federal debt ? $14.3 trillion ? includes money the government has borrowed from itself, mostly revenue from Social Security. Take out the borrowing between government agencies and Uncle Sam's net debt drops to $9.8 trillion, or about 64 percent of GDP.

Some debt analysts consider Australia a model for the way it has controlled its budget and prepared to pay for an aging society. Over the last two decades, Australia cut government spending, imposed a 10 percent tax on most goods and services and sold off state assets including airports and railways. Should we be popping the "Limitless" pill?

The movie "Limitless," which came out on DVD last week, presents a potential future fueled by designer drugs. When we meet the film's protagonist Eddie Mora (Bradley Cooper), he's a divorced, disheveled, socially awkward writer who can't even come up with the first words of his novel. After getting dumped by his girlfriend, Mora runs into his drug-dealing ex-brother-in-law who offers Eddie a solution in the form of a little round pill. Within minutes, the drug transforms Eddie into a brilliant, creative, driven alpha male who quickly and effortlessly completes his long-stalled book.

"Enhanced Eddie" then acquires a stash of these pills and, in rapid succession, cleans himself up, learns Italian, wins back his ex-girlfriend and becomes a celebrity investment banker.

The film's "miracle" drug may seem far-fetched, but it's based in a medical reality: Taking certain medications, specifically those developed to treat psychiatric and neurological disorders, can boost cognitive performance in otherwise healthy people.

Many of us instinctively recoil from such an idea for moral reasons. Sculpting our brains, unlike, say, sculpting our noses, seems like cheating. But consider this: 7 percent of surveyed college students (and some 25 percent of those on elite campuses) have taken an unprescribed Ritalin -- or a similar drug used to treat attention deficit disorder -- to boost their performance on an exam.

And the phenomenon is not restricted to college students trying to raise their grade point averages: The military has a history of encouraging -- and sometimes even ordering -- soldiers to take Ritalin or Provigil, a drug that boosts alertness. Canadian researchers are now looking at a drug called metyrapone that may help dull the sting of painful memories. Already common is the number of executives who swallow a little dose of Propranolol -- which is normally used to treat high blood pressure but has also been prescribed for performance anxiety for many years -- to calm their nerves before they speak. And with so many of us already hustling to Starbucks morning, noon and night for shots of caffeine to keep us going, the question arises: Is there a case to be made for cognitive enhancement?

A few years ago, a distinguished group of scholars claimed there was in an essay in Nature:

Human ingenuity has given us means of enhancing our brains through inventions such as written language, printing and the Internet ... And we are all aware of the abilities to enhance our brains with adequate exercise, nutrition and sleep ... drugs ... should be viewed in the same general category as education, good health habits, and information technology -- ways that our uniquely innovative species tries to improve itself.

The writers proposed a series of principles that would help society regulate these drugs responsibly and fairly. These rules stipulated that any mentally competent adult would be allowed to use cognitive enhancing drugs, that professional organizations would develop policies for their prescription and use, that detailed research would be conducted regarding their risks and benefits, and that access to such medications would be provided regardless of socioeconomic status. ?

The authors correctly point out that "there is certainly a precedent for this broader view in certain branches of medicine." Lifestyle drugs like Viagra are an over $30 billion a year business. And then there are substances like caffeine and alcohol that we commonly use as lifestyle drugs -- to keep us up, to help us relax, to make us focus, to put us to sleep -- even if we don't think of them that way. There are also those of us -- myself included -- who take drugs we wouldn?t normally think of as lifestyle drugs and use them as such. ?If I?m going to drink a few glasses of wine over dinner, or have an extra cup of coffee to get through my day, ?I?ll sometimes pop a Prilosec so that I don?t wake up in the middle of the night with heartburn.

But taking a pill to get an edge for that job interview or ace that test is deeply unsettling. On a visceral level, the idea that we're "playing God" with our minds disturbs us. There's also the question of what happens to our sense of accomplishment. What does it mean if achieving your dreams merely means popping a pill?

There are two more concrete arguments as well. First, access to these mind-altering substances would likely (at least initially) be limited to those with the money to afford them. The authors of the essay in Nature try to allay this fear by suggesting, somewhat naively, that every exam-taker have free access to cognitive enhancements "as some schools provide computers during exam week to all students." But it's easier to imagine the society predicted by the President's Council of Bioethics in 2003, where we see "the emergence of a biotechnologically improved aristocracy. [This] is indeed a worrisome possibility, and there is nothing in our current way of doing business that works against it. Indeed, unless something new intervenes, it would seem to be a natural outcome of mixing these elements of American society: our existing inequalities in wealth and status, the continued use of free markets to develop and obtain the new technologies, and our libertarian attitudes favoring unrestricted personal freedom for all choices in private life." ?

Finally, we can't ignore any known and unknown risks of the side effects of cognitive enhancers. In "Limitless," we see Eddie become increasingly dependent on his drug, which leads him to visual hallucinations and memory loss. With Ritalin, we worry about sleep disturbances, high blood pressure, weight loss and emotional instability. With Provigil, there are concerns of visual hallucinations, insomnia and depression.

Of course, it's easy to make these judgments in the abstract. But what if, for example, your child needs a lifesaving but risky and complex 15-hour surgery? Wouldn't you want that doctor to be as alert as possible throughout the procedure, even if that meant using Provigil or another cognitive-enhancer? Or what if your son is on the ground in Afghanistan? Wouldn't you want him to be able to take a dose of Ritalin before going on patrol, so he?s sharp and ready to defend himself? ?

But regardless of your personal feelings on that matter, our ability to innovate will continue to challenge our sense of morality. We can't simply pretend that these drugs don't exist. The writers in Nature deserve credit for being willing to start this conversation. Still, for all of their logic, their biggest fault is their dismissal of the role of human hubris and ambition. Perhaps Eddie Mora says it best: "There are no safeguards in human nature. We're wired to overreach."
