We heard a lot last week about the MacPhail family, who wanted Troy Davis executed despite serious, worldwide concerns about his innocence. But what about the loved ones of murder victims who oppose the death penalty?

Why haven't we heard many, if any, media accounts from James Anderson's family? Mr. Anderson, a black man, was allegedly run over by a truck driven by Deryl Dedmon, a white teenager, in Mississippi this past summer. Barbara Anderson Young, Mr. Anderson's sister, wrote a letter to the local District Attorney on behalf of their family indicating the family's opposition to the death penalty, which is "deeply rooted in our religious faith, a faith that was central in James' life as well." The letter also eloquently asks that Dedmon be spared execution because the death penalty "historically has been used in Mississippi and the South primarily against people of color for killing whites." It continues, "[e]xecuting James' killers will not help balance the scales. But sparing them may help to spark a dialogue that one day will lead to the elimination of capital punishment." Why isn't more of a big deal made about families of murder victims' of horrific crimes ? there is disturbing video of Mr. Anderson's beating and death ? who do not believe state-sponsored murder is the right answer?

And then there was Lawrence Brewer, executed by Texas last week ? the same day Georgia killed Troy Davis ? for the dragging death of James Byrd. Members of Mr. Byrd's family opposed the death penalty, despite the racist and vicious nature of the killing. Of Brewer's remorseless ? he said he had no regrets the day he was executed ? Byrd's sister, Betty Boatner, said, "If I could say something to him, I would let him know that I forgive him and then if he still has no remorse, I just feel sorry for him." Byrd's daughter shared that she didn't want Brewer to die because "it's easy . . .(a)ll he's going to do it go to sleep" rather than live every day with what he did and perhaps one day recognize the humanity of his victim. James Byrd's son, Ross, points out "You can't fight murder with murder . . .(l)ife in prison would have been fine. I know he can't hurt my daddy anymore. I wish the state would take in mind that this isn't what we want."

Some victims are able to seek healing separate from vengeance through the court system and lethal poison. Many thoughtful criminal justice advocates, like Sister Helen Prejean, affirm that it is a more lasting and complete healing.

Believe it or not, there are actually two national organizations, Murder Victims Families for Reconciliation and Murder Victims Families for Human Rights, as well as a number of state-based ones, comprised of murder victims' families who oppose the death penalty.

Yesterday was the fifth annual National Day of Remembrance for Murder Victims with observations around the country (such as Arkansas and New York) that encourage families to remember loved ones without violence.

Evans Report: 2011 seeing increase in real estate sales | The Glen ...

Real estate agents who sell single-family homes in Palm Beach may need to replace their Jimmy Choo pumps and Gucci loafers for the upcoming season.

The latest Evans Report sales analysis shows plenty of shoe leather hit the pavement during the first half of this year, when the number of house sales rose substantially over the same period last year.

The increase both reflects lower home prices and more confidence in the island?s real estate market, said Leslie Evans, the Palm Beach real estate attorney and property owner who prepares the reports.

?I?m optimistic. We?re seeing a big increase in sales,? said Evans, whose firm provides legal services to real estate agencies and their clients. ?If people didn?t think (prices) had bottomed out, they wouldn?t be buying here.?

His analysis shows that 81 single-family homes sold during the first and second quarters of this year, compared to 60 in the first six months of 2010. In the first half of 2009, when the real estate slump tightened its grip on the island, just 38 single-family homes changed hands.

Condo sales picture mixed

On the condominium scene, the report reveals a fairly stagnant market overall, with 157 Palm Beach condominiums sold during the first half of this year ? just five more than sold during the first half of 2010.

Still, condo sales were up substantially north of Sloan?s Curve, with the number of transactions rising from 51 in the first half of 2010 to 67 for the same period this year. But the median condo sales price in the same area, which includes the many Midtown buildings, was down ? from $869,000 last year to $625,000. The median is the price at which half the properties sold for more and half for less.

In the northern area, the highest-priced condominium during the period covered in the report was March?s $4.5 million sale in the Leverett House at 110 Sunset Ave., followed the same month by a $3.77 million sale in the Palm Beach Biltmore. Another three condos sold in the area for more than $2 million.

In the less-expensive Condominium Row area south of Sloan?s Curve, however, fewer condos sold during the first half of this year than in the same period of 2010. The number of transactions dropped this year to 90 from last year?s 101. But the median sales price there increased from $300,000 to $327,000, as buyers returned to the market and snapped up better-quality and pricier properties. That has left the market glutted with older, outdated units in lower price ranges, according to real estate brokers and agents.

Single-family action heats up

Although more single-family homes found new owners during the first six months of 2011, the report?s sales-price profile for them isn?t clear-cut. The median price of the homes sold in the first half of 2011 clocked in at $2.4 million, compared to $2.9 million for the same period last year. But when the sales prices of all of the homes sold are averaged, the number comes out to $5.1 million, higher than the $4.7 million average recorded for the first half of 2010.

Following longtime trends, there were more house sales in the second quarter of this year ? 54 ? than in the first quarter, when 27 changed hands.

Several price categories were substantially more active during the first half of this year than they were last year. For instance, five homes sold for more than $20 million between Jan.1 through June 30 of this year, compared to the sole house sold during the same period last year.

Also seeing more activity were homes sold in the middle range ? between $5 million and $10 million. Last year nine sold in that category during the first six months, while 14 sales were recorded in the latest report.

But the price category that saw the largest increase in the number of transactions involved houses that sold for less than $2.5 million. That bread-and-butter category likely reflected changing attitudes among sellers, who finally agreed to take less for their houses than they would have the year before. The report showed that 41 houses changed hands this year versus 25 last year.

Neighborhood distinctions

As for a geographic breakdown of the single-family home sales, the report showed that the most activity occurred in the North End, where the number of sales in the first six months rose from 43 last year to 48 this year. The median price in that area this year was $2.06 million, versus $2.35 million last year. The highest-dollar home sale in the area was 102 Canterbury Lane, which sold in March for $26.4 million. In the Midtown area, 15 single-family homes sold in the first six months of this year, compared to 10 in the first half of 2010. The median price there fell from about $3.21 million last year to about $2.21 million this year.

The South End and Estate Section saw the greatest number of sales of higher-end homes, the report confirmed. Eighteen houses changed hands there in the first half of this year, versus seven in the same period last year. And six of the 2011 sales were priced at more than $11 million.

The report showed the median sales price in the South End and Estate Section was down to about $8.6 million in 2011, compared from $11.6 million in 2010. The least expensive home changing hands there was 221 El Vedado Way, which sold in March for $3.8 million, while the most expensive was 40 Blossom Way, which brought $29.15 million in May. The latter remains the highest-dollar sale so far this year.

In all, $405 million worth of single-family homes and $106 million worth of condominiums changed hands during the first half of this year throughout Palm Beach.

?That?s over a half-billion (dollars in sales),? Evans said. ?We?re on track for a billion dollars (by the end of) 2011.?

The report also showed that like last year, there were no single-family homes sold in foreclosure during the first half of this year. But the report recorded five such units among the condos and cooperatives that changed hands. For the same period last year, nine apartments sold in foreclosure.

Evans said he and his staff compile sales and price figures from a variety of sources, including public records, newspaper articles and multiple listing services.

Cop pleads not guilty in homeless man's death

Lawyers for Fullerton Officer Manuel Ramos, 37, argued for reduction of his $1 million bail, saying Ramos feared for his life in jail. A judge denied the motion.

Ramos, a 10-year veteran, and Fullerton police Cpl. Jay Cicinelli, 39, were charged last week with killing Kelly Thomas, 37, during a violent arrest at the Fullerton Transportation Center on July 5.

Officers were responding to a report of possible vehicle burglaries at the site.

Ramos entered the plea in Orange County Superior Court before Judge Erick Larsh.

Cicinelli, a 12-year veteran, pleaded not guilty Friday to one count each of involuntary manslaughter and excessive use of force. He was released on $25,000 bail.

Prosecutors said Thomas was shocked four times with a Taser stun gun, kneed in the head, punched in the ribs and bashed eight times with the butt of a stun gun.

District Attorney Tony Rackauckas said the fight began when Ramos asked Thomas to place his hands on his knees.

When Thomas had trouble complying, Ramos snapped on a pair of latex gloves, held his fists in front of Thomas' face and said: "Now see my fists? They are getting ready to F you up," the prosecutor said.

He then went on to swing his baton at Thomas, chased him and eventually pinned him to the ground with his body, authorities said.

The coroner concluded the cause of death was mechanical compression of the thorax, which made it impossible for Thomas to breathe normally and deprived his brain of oxygen, Rackauckas said. Other injuries to the face and head contributed to his death.

Cicinelli, who arrived later, kneed Thomas twice in the head and used a Taser on him as he screamed and yelled in pain, Rackauckas said.

An FBI investigation is under way to determine if Thomas' civil rights were violated.

Rackauckas, a longtime prosecutor known for his strong backing of law enforcement, said it was the first time he had filed charges against police officers for excessive force leading to death.

"Police officers have a right to use reasonable force in the performance of a lawful duty but citizens have a right to self-defense, even against the police," he said.

Thomas suffered severe head and neck injuries and was taken off life support five days after the incident.

Thomas suffered from schizophrenia and lived on the streets even though he received support from family and friends.

With Romney and Perry elbowing each other for front-runner status ? and tea party darling Michele Bachmann trying to wedge herself into the top tier ? the presidential contenders scheduled a forum on their faith and a head-to-head debate for Thursday. They will also make appearances at a conservative conference on Friday and some will visit a nonbinding test vote of the party faithful on Saturday.

A poll released early Thursday indicates Florida Republicans slightly prefer Perry over Romney in their party's battle to find a nominee to face President Barack Obama next year.

Their camps descended on senior citizen-rich Florida this week, ready with lines sharpened for fellow Republicans more than for their once-favorite target, Obama.

?Because the buyer?s agent has already been paid for their services in full, the money that is traditionally earmarked as a commission payment for that agent is then returned to the home buyer in the form of a rebate or a reduction on the overall cost of the home. The result is that agents get paid for their time when services are rendered and not based on a contingency plan and home buyers now have an option of buying just the home buying support and services that they need while also having the potential to save thousands of dollars on the purchase of their home. It?s a win-win situation for both sides.?

A recent marketing partnership with Citibank will help home buyers cover upfront costs by offering a credit card with the necessary balance needed to pay for the services of the buyer?s agent upfront and therefore alleviate the issue of requiring that buyers have cash on hand to prepay for their agent?s services.

?By being paid for the work they do when they do it, Realtors? no longer need to focus purely on getting their clients to the closing table in order to get paid for their time and services. They also eliminate the risk they traditionally take on because the onus for buying the house now sits squarely on the shoulders of the home buyers. Also, the Realtor?s? services become part of the real estate process and not part of the home sale which allows them to step out of ?salesperson? mode and to instead serve more as an advisor or consultant to help assure that their clients get the best deal possible.?
